Class Action Law Suit!

by JD on April 22, 2010

In the mail the other day I received a post card that said “Court-Ordered Legal Notice”. That kind of gets your attention and your blood flowing! It is about a lawn mower settlement. I purchased a lawn mower last year – Honda self-propelled. It appears that Honda, along with just about every other major brand of lawn mower (the list had over 23 companies), was involved in a class action law suit that claimed the defendants misrepresented and overstated the horsepower of their lawn mowers and lawn mower engines. Anyway, the parties have agreed to settle. Since I purchased a lawn mower last year, I am entitled to submit a claim form to get a payment or an extended engine warranty. I have until August 31, 2010 to decide. The payment could be as large as $35!

I am undecided about this. If the companies did misrepresent, that is their bad (although it doesn’t really effect my grass cutting at this point!). There is no safety issue involved, and my mower works great. This doesn’t seem like a big deal to me that the horsepower claims might be off – let alone take this to court. It almost sounds frivilous. And I do not want to be part of adding to our lawsuit happy nation. If I do anything, it probably would be to get the extended warranty.

So what are your thoughts? Grab the money from the “evil corporations” and help the “evil lawyers” or forget the “evil lawyers” and help the “evil corporations”? What a dilemma!
